Home buyers appealed to reject amendments to UP Apartment Act

appartment-copyNEW DELHI: More than 200 home buyers in Noida and Gr. Noida have appealed to the Governor not to approve the Uttar Pradesh Apartment Amendment Bill, 2016.

 

They gave the reason that the new bill will promote unauthorized constructions in group housing projects and lead to delay in project deliveries.

 

Buyers also claim that the changes have been floated with an aim to secure many builders, whose projects have been stayed by the High Court on the basis of petitions filed by the buyers against illegal constructions.

 

Driven by the Noida Extension Flat Owners Welfare Association (NEFOWA), these purchasers have composed letters to the Governor, raising worries about the alterations to Section 4(4) and erasure of Section 4(5) of the Uttar Pradesh Apartment Act, 2010.

 

The UP Assembly a week ago cleared changes to the Uttar Pradesh Apartment (Promotion of Construction, Ownership and Maintenance) Amendment Bill, 2016.

 

Section 4(4) of the Apartment Act mandates the builder to obtain prior consent of the development authority and the home buyers before making any change to the original layout plans and specifications of the housing project. However, the Amendment Bill has done away with the requirement of consent from the intending apartment owner.

 

Section 4(5) of the Apartment Act, which mandated the builder to complete the construction within two years from the date of the sale agreement, has also been done away with in the new bill.

 

"These amendments will remove transparency from the real estate sector. The builder will no longer be answerable to the buyers for any delay in the project or for indulging in additional constructions," said Abhishek Kumar, president, NEFOWA, adding, "We will move court if this bill gets approval."

 

NEFOWA also led a twitter campaign #No House No Vote, where about 100 buyer from various projects of Noida and Gr. Noida went on a mass tweeting spree. It also started a signature campaign to reach voices of the buyers to the UP chief minister Akhilesh Yadav recently.
